EU Inc: Council adopts position on a common corporate-law framework
The proposal provides for an optional European regime and online company formation within two days, costing up to €100. Negotiations follow; it is not yet an applicable regulation.

The Council of the European Union adopted its negotiating position on EU Inc on 23 October 2026. The proposed optional “28th regime”, alongside national company laws, aims to facilitate innovative companies’ cross-border growth.
What the proposal provides
The position includes online formation within two days, at a maximum cost of €100, and a digital share register. Preventive checks and grounds for refusing registration remain, including money-laundering or criminal purposes.
The remaining stage
Negotiations with the European Parliament can begin once Parliament adopts its position. A 21-month implementation period is proposed for member states; it does not start with today’s announcement. There is no final regulation or operational EU Inc formation service yet.
